Ontario Land Tribunal case dates set regarding proposed subdivision

The Case Management Conference (CMC) about the appeal submitted by CAIVAN (Perth GC) Limited (Case Number OLT-23-000534) was held on Thursday, Dec.14. In addition to the representatives for the Town of Perth, Lanark County, and CAIVAN, more than 100 individuals attended the virtual session. 

During the CMC, it was agreed by all parties to award 52 individuals with participant status. A decision regarding granting party status to a group of residents has been deferred to a second CMC so that further information can be provided to, and reviewed by the party. Logistics of the OLT hearing were discussed between members of the OLT and counsels for the application, Town of Perth, and Lanark County, including deadlines for providing information, length of the hearing, and scheduling.

The next steps in the process are as follows; 

  • Monday, Jan. 22 – All participant statements are to be filed with the OLT.
  • Monday, Jan. 29 – Revised issues to be outlined to the OLT by the applicant, the Town of Perth, and Lanark County. 
  • Monday, Feb. 12 at 10 a.m. – Second Case Management Conference to be held by video hearing (details will be released as they become available).
  • Monday, Aug. 19-Friday, Sept. 13 – Four-week hearing regarding Case Number OLT-23-000534 (dates subject to change). Note that the Tribunal will not be sitting on Monday, Sept. 2 and Monday, Sept. 9. 

The Town will continue to provide information to the public relating to this OLT hearing as it is available, through the Town’s website and social media. As the matter is now one of a legal capacity, Town staff and Council are not able to provide comment on the case.
